Terms of Use

These Terms of Use ("Terms") are between you and MIX CENTURY SERVICES SDN. BHD. ("Mix Century", "we", "us", or "our") and apply to the PACEVARO app, related Apple-platform experiences, websites, support, and services. By downloading, accessing, or using PACEVARO, you agree to these Terms and the applicable Apple terms. If you do not agree, do not use PACEVARO.

Eligibility and accounts

You must be legally able to agree to these Terms where you live. PACEVARO is not directed to children under 13. If you are below the age of legal majority, a parent or guardian must review these Terms and provide any consent required by local law.

Most core features work without an account. Sign in with Apple is required to verify optional AI Coaching and subscription access. You are responsible for protecting access to your Apple Account and device and for information submitted through your account.

Licence to use PACEVARO

Subject to these Terms and Apple's usage rules, Mix Century grants you a personal, limited, revocable, non-exclusive, non-transferable licence to use PACEVARO on Apple-branded devices that you own or control. You may not copy, sell, rent, sublicense, reverse engineer except where law permits, bypass security or usage limits, or commercially exploit the app without written permission.

Fitness guidance only

PACEVARO provides general fitness, running, and trail-running guidance. It is not a medical device or emergency service and does not diagnose, treat, cure, or prevent medical conditions or injuries. It is not a substitute for advice from a qualified healthcare professional or coach who knows your circumstances.

Running and trail running involve risks including falls, traffic, terrain, weather, heat, altitude, overtraining, injury, and medical events. You are responsible for evaluating your health, surroundings, equipment, route, conditions, fatigue, and ability before and during activity. Stop training and seek appropriate help when pain, illness, injury, unusual symptoms, or safety concerns require it. In an emergency, contact local emergency services.

Plans, predictions, weather, and results

Training plans and race predictions depend on the information available and cannot guarantee performance, health outcomes, or race results. You remain responsible for evaluating conditions, terrain, weather, fatigue, and your ability before training.

Weather information may be delayed, incomplete, or inaccurate and must not be used as an emergency warning service. Check authoritative local forecasts, alerts, trail conditions, and safety guidance.

Apple Health and optional AI

You control Apple Health permissions and can revoke them in iOS Settings. Health and fitness information may be incomplete, delayed, estimated, or affected by sensors and third-party sources.

Optional AI guidance requires a PACEVARO session created with Sign in with Apple and sends a compact, purpose-specific recent training summary through a secure service operated by Mix Century to OpenAI. It does not send your full Apple Health database or a full year of raw workouts. No provider API key is stored in the production app.

AI output may be inaccurate, incomplete, unsuitable, or inconsistent. It is generated guidance, not professional or medical advice. Review every plan and recommendation, use your own judgment, and do not rely on AI output where an error could cause harm. You remain responsible for every training decision.

Subscriptions and paid features

PACEVARO Core remains available without a paid subscription. An eligible first-time account receives one AI weekly plan and one AI race review through the non-renewing Welcome Pass. Optional PACEVARO AI Coaching is offered as an auto-renewable monthly or annual subscription through Apple In-App Purchase. Standard access includes up to 12 AI plan generations per month, with a maximum of 3 per Monday-Sunday week; 4 AI weekly reviews per month, with one saved review per selected completed week; and 4 AI race reviews per month, with a maximum of 1 per week. Manual workout swaps do not use AI allowance.

Payment is charged to your Apple Account after confirmation. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. Your Apple Account is charged for renewal within 24 hours before the period ends. Apple displays the final localised price, currency, taxes, billing period, and any offer before purchase. You can manage or cancel the subscription in Apple Account subscription settings. Deleting PACEVARO or your PACEVARO account does not cancel an Apple subscription.

Billing, cancellation, and refunds are administered by Apple and are subject to Apple's terms and the mandatory rights where you live. Usage allowances, feature details, and eligibility may change for future billing periods with reasonable notice where required. Changes do not remove rights already provided by law.

Your content and backup files

You retain ownership of information and photos you create or select. You grant Mix Century only the limited rights necessary to process information when you request a service, such as AI Coaching, account verification, or support. You confirm that you have the right to use any content you provide and that it does not violate law or another person's rights.

Manual backup and export files are under your control and may contain sensitive information. Build 15 limits manual backup files to 1 GB and compresses eligible photos during export. You are responsible for choosing a secure destination, protecting access, and deleting copies you no longer need. Build 15 can optionally synchronize curated small setup records weekly through the user's Apple iCloud account between compatible iPhones using the same Apple Account. This setup sync excludes photos, raw HealthKit data, and general workout caches and is not a complete backup. Availability and reconciliation depend on Apple's iCloud service, device settings, and the user enabling the feature.

Acceptable use

You must not misuse the app or service, interfere with its operation, attempt unauthorised access, probe or bypass security or usage limits, automate abusive requests, share service credentials, infringe intellectual-property or privacy rights, submit malicious content, or use PACEVARO for unlawful activity. We may limit or suspend access reasonably necessary to protect users, the service, providers, or legal compliance.

Third-party services

PACEVARO works with services supplied by Apple, OpenAI, Cloudflare, and Open-Meteo. Their availability and processing are governed by their applicable terms and privacy policies. We are not responsible for independent third-party services to the extent permitted by law, but this does not limit responsibilities that applicable law places on Mix Century.

Intellectual property

PACEVARO, its software, design, branding, text, and other materials are owned by Mix Century or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you. Apple and other names and marks belong to their respective owners.

Availability, updates, and test versions

We may update, improve, replace, suspend, or discontinue features, subject to applicable law. The app may occasionally be unavailable or contain errors. Keep an appropriate backup of app-created information that matters to you.

TestFlight and other pre-release versions may contain incomplete features, changed calculations, errors, data loss, and interrupted availability. They are provided for testing and may be withdrawn. Feedback you voluntarily provide may be used to improve PACEVARO.

Account deletion and termination

You may delete your server-held PACEVARO account in Settings > Back up & restore. Account deletion does not delete Apple Health data, automatically erase all local app records, or cancel an Apple subscription. You may separately delete local information, delete the app, manage subscriptions through Apple, and revoke Sign in with Apple access in your Apple Account settings.

We may suspend or terminate access for a material breach, abuse, security risk, legal requirement, or discontinuation of the service. Where required, we will provide notice and an opportunity to remedy. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute terms—continue to apply.

Disclaimers

To the maximum extent permitted by applicable law, PACEVARO is provided "as is" and "as available." We do not promise that the app will always be uninterrupted, error-free, secure, or suitable for every person, condition, device, race, or goal. We disclaim implied warranties only to the extent they may legally be disclaimed.

Limitation of liability

To the maximum extent permitted by applicable law, Mix Century will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of data, opportunity, profits, or goodwill arising from use of PACEVARO. Nothing in these Terms excludes or limits liability that cannot legally be excluded, including applicable consumer guarantees or liability for fraud, wilful misconduct, or personal injury where such a limitation is prohibited.

Governing law and disputes

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law rules. This choice does not deprive you of mandatory consumer protection or the right to bring a claim in a court or forum available under the law where you live. Before starting formal proceedings, please contact us so we can try to resolve the issue, unless urgent relief or local law makes that unnecessary.

Apple terms

Use of the App Store version is also subject to Apple's Standard End User License Agreement and applicable Apple Media Services terms. These Terms supplement those terms and do not expand your licence beyond Apple's usage rules. Apple is not responsible for PACEVARO, its content, support, or any claims relating to the app, except as Apple's terms or applicable law expressly provide.

Changes to these Terms

We may update these Terms when PACEVARO, its commercial terms, providers, or legal requirements change. We will update the date above and provide additional notice when required. If a material change requires consent, we will request it. Continued use after an effective update constitutes acceptance only where permitted by law.
